Racine County Sheriff Refers Election Fraud Charges for State Elections Commissioners to County District Attorney’s Office

Wisconsin’s Democrat Governor Tony Evers said on Tuesday that Racine County officials should file charges if they believe election laws were broken at a Racine nursing home. “It’s pretty simple,” Evers said during a news conference in Madison. “It’s not something that should be made more complex by the politics. Somebody screwed up, they should be prosecuted. Simple as that.”

The Racine County Sheriff on Wednesday decided to take the governor’s suggestion to heart, and sent a felony criminal referral for members of the Wisconsin Election Commission (WEC) to prosecutor’s office.

Sheriff Christopher Schmaling and Sgt. Michael Luell last week presented evidence at a press conference showcasing blatant violations of election fraud at the Mount Pleasant nursing home, including evidence of staffers committing voter fraud by stealing elderly residents’ votes.

Convinced that the election fraud his investigation discovered in Racine was just the tip of the iceberg,  Schmaling called for a statewide investigation.  Wisconsin Attorney General Josh Kaul, a Democrat, however, has refused to accept the sheriff office’s report.

In a statement on Wednesday, the sheriff again called on Kaul to conduct a statewide investigation into the illegal directives issued by the Wisconsin Election Commission.

In the directives, the Wisconsin Election Commission ordered the voting clerks in every municipality in the state to “not use the Special Voting Deputy ‘process’” as required by Wis. Stat. § 6.875.
Based upon the failure of Attorney General Josh Kaul to initiate a statewide investigation, I have forwarded charging recommendations to the Racine County District Attorney’s Office for their review. The recommended charges are for Commissioners Margaret Bostelmann, Julie Glancey, Ann Jacobs, Dean Knudson, and Mark Thomsen.
The recommended charges are the same for each commissioner, and include:
• Misconduct in Public Office in violation of Wis. Stat. § 946.12(2) (Felony)
• Election Fraud – Election Official Assisting with Violations in violation of Wis. Stat. § 12.13(2)(b)7 (Felony)
• Party to the Crime of Election Fraud – Receive Ballot Non-Election Official in violation of Wis. Stat. § 12.13(3)(n) (Misdemeanor)
• Party to the Crime of Election Fraud – Illegal Ballot Receipt in violation of Wis. Stat. § 12.13(3)(p) (Misdemeanor)
• Party to the Crime of Election Fraud – Solicit Assistance in violation of Wis. Stat. § 12.13(3)(s) (Misdemeanor)

Schmaling said the reasons for the recommended charges were thoroughly explained during the October 28 news conference and in the supporting documentation.
