Commentary: What Happens in New York Doesn’t Stay in New York

It seems like every day America is becoming more anti-American than the day before. The Biden administration just keeps shooting for the “how can we out-do ourselves in pushing our Marxist policies” prize, and blue states are in lockstep. The American people keep getting whacked day in and day out, and the media is complicit. No one is safe these days in Biden’s America.

It’s hard to keep up with all the unconstitutional activities of Biden and his federal, state, and local cohorts but recent actions by New York can’t be missed. All Americans need to know and must be outraged by New York, whether you live there or in any other state. Why? Well, the New York Department of Health recently pushed out a memorandum for health-care providers and facilities with directives for dispensing COVID-19 antiviral treatments. Simply put, the Department of Health’s directive is steeped in racism. This isn’t just a shockingly outrageous move affecting New Yorkers, it reflects the anti-American, Marxist mindset these leftist governments seek to impose throughout our country, and it’s dangerous for us all.

The New York DOH memorandum gives priority to “non-white” and “Hispanic/Latino” individuals to receive lifesaving COVID-19 drugs (in scant supply, thanks to Biden) regardless of whether these individuals even have health-risk factors warranting such drugs. In other words, New York has decreed a racist litmus test, and health care workers are directed to fall in line and make medical decisions based on racism, not science.

That’s right, health care workers must accept that being of a “[n]on-white race or Hispanic/Latino ethnicity” in and of itself is a risk factor warranting treatment. And New York’s rationale? It’s so appalling that it’s best to refer right to the Health Department’s own memorandum, which provides, “longstanding systemic health and social inequities have contributed to an increased risk of severe illness and death from COVID-19.”

What better way to justify race-based preferences and discrimination than to employ the classic leftist rhetoric of the oppressed vs. the oppressor, rather than making analyses and decisions based on factors which are, dare we say, race and ethnicity neutral. Ignore that doctors and health care workers are trained to base their health care decisions and treatment plans on science.

New York has now dictated that these health care workers must dispense medicine based on someone’s skin color or ethnicity. That is ipso facto racism. It also violates the Fourteenth Amendment of the United States Constitution which prohibits state officials from discriminating on account of race or ethnicity, the New York Constitution, Article I, Section 11, which bans discrimination of a person’s civil rights because of race, color, creed or religion, and Title VI of the Civil Rights Act of 1964, which prohibits discrimination based on race, color, or national origin.

It also violates the infamous and disastrous Obama-Biden Affordable Care Act (a misnomer if there ever was one) which, at Section 1557, prohibits racial discrimination in any health program or activity that receives federal financial assistance.

The media, of course, is happily complicit as it covers for NY, and other states, for that matter. Take The Washington Post. Despite NY’s race-based treatment directive, which WaPo even admits to in an article, the WaPo title provocatively blares “Former Trump advisor falsely claims states are rationing scarce covid treatments based largely on race.”

Perhaps WaPo thinks so little of its readers that they won’t read past the headline, but Stephen Miller, former advisor, and now President of America First Legal was right when he called out NY’s illegal policy. AFL isn’t just talk. It has taken NY to court to enjoin its racist and unconstitutional directive rationing covid medicine based on skin color and ethnicity.

No one in America should tolerate these racist policies imposed by any level of government. No government, whether federal, state, or local, should get away with violating the federal and state constitutions, as well as federal or state law. What happens in New York affects us all. Today, New York, next week your state. We all need to know about this tyranny, stand up to it, and fight it.

No more giving an inch because an inch becomes a mile, and a mile becomes sea to shining sea.
